This document sets forth the only warranties provided by Computrols concerning the Direct Digital Controller products and other items purchased from Computrols but not manufactured by Computrols. This warranty is made expressly in lieu of all other warranties, express or implied, including without limitation any implied warranties of fitness for a particular purpose, merchanability, non-infringement, title or otherwise.
General
The Lifetime Warranty is applicable only to Direct Digital Controllers manufactured by Computrols with the exception of the actuator supplied with the VAV Small. This warranty covers UPS Ground shipping charges of the replacement item to the Owner. Next Day or Second Day Air shipping is available for replacement parts at an additional charge. Return shipping charges are the responsibility of the Owner. This warranty is non-transferable. Defective items not returned within 14 days of issuance of the RMA number will be billed in full. Manufacturer’s Warranty shall be honored by Computrols on all items purchased from Computrols but not manufactured by Computrols.
Exclusions
This warranty excludes failure of a Computrols Direct Digital Controller caused by acts of God including, but not limited to earthquakes, storms, fires, or flood. Computrols shall not be responsible for delays or failures (including any delay by Computrols to make progress in the prosecution of supplying replacement parts) if such delay arises out of causes beyond control. Such causes may include, but are not restricted to, acts of God or of the public enemy, fires, floods, epidemics, riots, quarantine restrictions, strikes, freight embargoes, earthquakes, electrical outages, computer or communications failures, severe weather, hurricane, tornado, lightning, water damage, corrosion, war, civil insurrection, vandalism, damage caused by third parties, power failure, power surge or damage caused by the Owner’s employees or agents, and acts or omissions of subcontractors or third parties.
